With Legislative Decree no. 145 of 18 December 2023, more commonly known as the Anticipi decree, the obligation of the National Identification Code (CIN) for tourist rentals of less than 30 days comes into force.
After an initial experimental phase involving some regions, from North to South Italy, including Marche, all hotel and non-hotel accommodation facilities will have 60 days from publication in the Official Journal, which took place on 3 September 2024, to comply.
The Ministry of Tourism specifies that the provisions of Article 13-ter, Legislative Decree no. 145 of 18 October 2023 will therefore apply from 2 November 2024, under penalty of a series of sanctions that vary based on the type of violation.
It will be mandatory for all owners of properties intended for short-term rentals to register in a National Database (BDSR) and obtain a National Identification Code (CIN) to be displayed both outside the accommodation and in all online advertisement. This is a national innovation aimed at establishing homogeneous parameters and standardized processes in order to guarantee consumer protection and market transparency. The BDSR, managed directly by the Ministry of Tourism, records and monitors both residential real estate units intended for rental contracts for tourism purposes or short-term rentals and hotel and non-hotel accommodation facilities.
The CIN request procedure will be accompanied by a substitute declaration pursuant to articles 46 and 47 of decree 28/12/2000 n. 45 which certifies the cadastral data of the real estate unit and the existence of the safety requirements of the systems as provided for in the Advance Decree.
Among the new legal obligations for short-term rentals managed both in an entrepreneurial and non-entrepreneurial form, it is necessary to install functioning gas and carbon monoxide detection devices, in addition to the insertion of at least one fire extinguisher every 200 square meters and for each floor of the real estate unit.
The National Database is currently enabled for interoperability with the regional and autonomous provincial databases, so properties equipped with a CIR (Regional Identification Code) obtain the CIN as a priority compared to those without one. Since one is a prerequisite for obtaining the other, both obligations will be maintained and the alphanumeric codes will be equally displayed outside the property and in every online ad.
Up until now, for the properties in our portfolio, we have scrupulously observed the consolidated text of the regional regulations on Tourism (Regional Law no. 9/06) which, with article art. 43 ter, established the register of accommodation facilities in which only those with a Regional Identification Code (CIR) were registered and which had therefore completed all legal requirements. Short-term rentals are often subject to changes and innovations, promptness in responding and the ability to adapt to regulatory requests are just some of the bureaucratic tasks that a structured and specialized company like fued can fulfill on behalf of the owner.
